A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each clas- sification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan trans- portation fund and the use and administration of the fund for transportation purposes; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety pur- poses; to set up and establish the Michigan truck safety commis- sion; to establish certain standards for road contracts for cer- tain businesses; to provide for the continuing review of trans- portation needs within the state; to authorize the state trans- portation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropria- tions and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to pro- vide for the establishment and administration of the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive 06558'02 * MRM 2 transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submis- sion of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and offi- cials; to provide for the making of loans for transportation pur- poses by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts," by amending section 19 (MCL 247.669). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 19. (1) The EXCEPT AS MAY BE PROVIDED OTHERWISE IN 2 THIS SECTION, THE board of county road commissioners in each of 3 the several counties COUNTY shall, within 1 year from the 4 effective date of this act JUNE 1, 1951, complete the taking 5 over as county roads of all roads, streets, and alleys 6 heretofore required to be taken over as county roads by the 7 provisions of Act No. 130 of the Public Acts of 1931, as 8 amended, being sections 247.1 to 247.13, inclusive, of the 9 Compiled Laws of 1948 UNDER FORMER 1931 PA 130. Said THE 10 board of county road commissioners in each of the several 11 counties COUNTY shall take over as county roads all streets and 12 alleys lying outside the limits of incorporated cities and vil- 13 lages and dedicated to the public in recorded plats approved by 14 said THE board of county road commissioners, within 30 days 15 after the recording of the plat or the effective date of this 16 act JUNE 1, 1951, whichever may be the IS later. Such 17 dedicated DEDICATED streets and alleys, when taken over by the 06558'02 * 3 1 county road commission, shall be county roads in all respects 2 and for all purposes and shall be classified as county primary 3 roads or county local roads pursuant to the provisions of UNDER 4 this act. 5 (2) A CHARTER TOWNSHIP WITH A POPULATION OF 35,000 OR MORE 6 MAY ASSUME JURISDICTION OF THE COUNTY PRIMARY, SEASONAL, AND 7 LOCAL ROADS WITHIN THE TOWNSHIP BOUNDARIES IF ALL OF THE FOLLOW- 8 ING EVENTS OCCUR: 9 (A) A MAJORITY OF ELECTORS IN THE TOWNSHIP VOTE TO ASSUME 10 JURISDICTION OF THE ROADS. 11 (B) THE TOWNSHIP BOARD ADOPTS A RESOLUTION TO ASSUME JURIS- 12 DICTION OF THE ROADS. 13 (C) THE BOARD OF COUNTY COMMISSIONERS ADOPTS A RESOLUTION 14 APPROVING THE TRANSFER OF THE ROADS. 15 Enacting section 1.
