        A bill to amend 1998 PA 58, entitled

   "Michigan liquor control code of 1998,"

   by amending section 811 (MCL 436.1811), as amended by 1998 PA

   416.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

             Sec. 811.  The insurance policy described in this chapter

 2
        shall cover the liability imposed by section 801 and shall con-

 3
        tain the following conditions:

 4
              That  EXCEPT WHERE THE INSURER CAN DEMONSTRATE PREJUDICE

 5
        FROM THE INSURED'S BREACH OF THE POLICY, CONDITION, PROVISION,

 6
        STIPULATION, OR LIMITATION, no condition, provision, stipulation

 7
        or limitation contained in the policy, or any other endorsement

 8
        thereon, shall relieve the insurer from liability (within the

 9
        statutory limits provided by section 803 of the Michigan liquor

10
        control code of 1998), for the payment of any claim for which the

        insured may be held legally liable under section 801 of  said

        THAT act.

             Enacting section 1.  This amendatory act applies to policies

 4
        issued or renewed on or after January 1, 2003.
