        A bill to amend 1909 PA 278, entitled

   "The home rule village act,"

   by amending section 9 (MCL 78.9).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

             Sec. 9.  (1) On the filing in the office of the secretary of

 2
        state and the clerk of the county or counties within which the

 3
        village is located, of a copy of the petition  ,  and of every

 4
        resolution, affidavit, or certificate necessarily following

 5
         such  A petition, with the certificate of the board of county

 6
        canvassers attached, showing that the purposes of  said  THE

 7
        petition have been approved by a majority of the electors voting

 8
         thereon  ON THE PETITION as provided in this act, the number of

 9
        votes cast on  such  THAT proposition and the number cast for and

10
        against the  same  PROPOSITION, the village  shall be  IS from

11
        that date duly and legally incorporated under and by the name

        designated in  said  THAT petition, or the territory described in

 2
         said  THAT petition  shall be  IS duly and legally consolidated

 3
        as 1 village, or attached to or detached from the village named

 4
        in  such  THAT petition, as the case may be, and  such  THAT

 5
        petition and the subsequent proceedings  thereunder  UNDER THAT

 6
        PETITION shall be duly recorded in each of  said  THE VILLAGE

 7
        offices in a book to be kept for that purpose.  , and either of

 8
        such  THE records or certified copies  thereof  OF THE RECORDS

 9
        shall be prima facie evidence of the due and legal incorporation

10
        of the village or of the consolidation or change of boundaries

11
        prayed for in  such  THE petition.  Territory detached from any

12
        village shall  thereupon  become a part of the township, village

13
        or city from which it was originally taken.  :  Provided, That

14
        the

             (2) THE secretary of state shall, within 10 days after the

16
        filing in his OR HER office of the certified copies as required

17
        by this section, make and file with the  auditor general  STATE

18
        TREASURER a certificate showing the name of the village thus

19
        incorporated, a description of the land included within the

20
        limits of  said  THE village, or in case of a change of bounda-

21
        ries of any village a description of the land attached to or

22
        detached from  such  THAT village.
