HOUSE BILL No. 4627 April 19, 2001, Introduced by Reps. Allen, Julian, Birkholz, Drolet, Lockwood, Neumann and Shackleton and referred to the Committee on Commerce. A bill to define certain rights and responsibilities of hotels and bed and breakfasts with respect to renting or leasing hotel or bed and breakfast rooms to minors; and for related purposes. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. Except as provided in section 2, a hotel or bed and 2 breakfast may refuse to rent or lease a hotel room or a bed and 3 breakfast room to a minor. 4 Sec. 2. A hotel or bed and breakfast shall not refuse to 5 rent or lease a hotel room or a bed and breakfast room to a minor 6 if any of the following apply: 7 (a) The minor is an emancipated minor. 8 (b) A parent or guardian of the minor has reserved the room 9 for the minor in advance and has agreed in writing to accept the 10 liability for the cost of the room and use of the facilities and 03903'01 DAM 2 1 other privileges of the hotel or bed and breakfast used by the 2 minor and for the cost of any damages to the room, furnishings in 3 the room, or other facilities of the hotel caused by the minor or 4 his or her guests. The hotel or bed and breakfast may require 5 that the parent or guardian provide written authorization to 6 charge a credit card of the parent or guardian for this liability 7 or require a cash deposit in an amount determined by the hotel or 8 bed and breakfast. 9 (c) The minor clearly demonstrates to the hotel or bed and 10 breakfast that he or she has experienced a roadside emergency 11 that requires that he or she seek temporary lodging. 12 (d) A weather-related emergency exists that requires that 13 the minor seek temporary lodging. 14 Sec. 3. A hotel or bed and breakfast may require that an 15 individual provide documentary evidence confirming the age of an 16 individual renting or leasing a hotel room or bed and breakfast 17 room or documentary evidence of the emancipation of a minor, 18 including a motor vehicle operator's or chauffeur's license, a 19 registration certificate issued by the federal selective service, 20 a marriage license, or other bona fide documentary evidence of 21 the age and identity of the individual or emancipation of the 22 minor. 23 Sec. 4. As used in this act: 24 (a) "Bed and breakfast" means that term as defined in sec- 25 tion 4b of the Stille-DeRossett-Hale single state construction 26 code act, 1972 PA 230, MCL 125.1504b. 03903'01 3 1 (b) "Emancipated minor" means a minor who is emancipated 2 under section 4 of 1968 PA 293, MCL 722.4. 3 (c) "Hotel" means that term as defined in section 1 of 1913 4 PA 188, MCL 427.1. 5 (d) "Minor" means an individual under 18 years of age. 03903'01 Final page.
