HOUSE BILL No. 4511 March 22, 2001, Introduced by Reps. DeVuyst, Patterson, Howell, Sanborn, Birkholz, Richardville and Richner and referred to the Committee on Conservation and Outdoor Recreation. A bill to amend 1969 PA 287, entitled "An act to regulate pet shops, animal control shelters, and animal protection shelters; to establish uniform procedures and minimum requirements for adoption of dogs, cats, and ferrets; and to prescribe penalties and civil fines and to provide remedies," by amending section 1 (MCL 287.331), as amended by 1997 PA 7. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Adoption" means a transfer of ownership, with or with- 3 out remuneration, of a dog, cat, or ferret from an animal control 4 shelter or animal protection shelter to an individual for the 5 purpose of being a companion animal for that individual. As used 6 in this subdivision, a companion animal includes but is not 7 limited to a dog that is used for hunting or as a guard dog. 00240'01 LBO 2 1 (b) "Alteration" means a professional sterilization 2 procedure performed by a veterinarian that renders a dog, cat, or 3 ferret incapable of reproducing. 4 (c) "Altered", in reference to a dog, cat, or ferret, means 5 having undergone alteration. 6 (d) "Animal" means a mammal AND NONFURBEARING ANIMALS, 7 except livestock as defined in 1937 PA 284, MCL 287.121 to 8 287.131, and rodents. 9 (e) "Animal control shelter" means a facility operated by a 10 municipality for the impoundment and care of animals that are 11 found in the streets or at large, animals that are otherwise held 12 due to the violation of a municipal ordinance or state law, or 13 animals that are surrendered tothe animal control shelterTHAT 14 FACILITY. 15 (f) "Animal protection shelter" means a facility operated by 16 a person, humane society, society for the prevention of cruelty 17 to animals, or any other nonprofit organization for the care of 18 homeless animals. 19 (g) "Cat" means a domestic cat of any age of the species 20 felis catus. 21 (h) "Department" means thestateMICHIGAN department of 22 agriculture. 23 (i) "Director" means the director of the department or his 24 or her authorized representative. 25 (j) "Dog" means a domestic dog of any age of the species 26 canis familiaris. 00240'01 3 1 (k) "Ferret" means an animal of any age of the species 2 mustela furo. 3 (l) "Health certificate" means a certificate in a form pre- 4 scribed by the department in which a veterinarian attests to the 5 age, sex, breed, and description of an animal,and to the fact 6 that at the time of preparation of the certificate, the veteri- 7 narian examined the animal and found the animal free from visual 8 evidence of communicable disease. 9 (m) "Municipality" means a county, city, village, or 10 township. 11 (N) "NONFURBEARING ANIMAL" MEANS A MEMBER OF THE ZOOLOGICAL 12 CLASSES OF AMPHIBIA AND REPTILIA. 13 (O)(n)"Person" means an individual, partnership, corpo- 14 ration, association, governmental entity, or other legal entity. 15 (P)(o)"Pet shop" means a place where animals are sold or 16 offered for sale, exchange, or transfer. 17 (Q)(p)"Veterinarian" meansa personAN INDIVIDUAL 18 licensed to practice veterinary medicine under article 15 of the 19 public health code, 1978 PA 368, MCL 333.16101 to 333.18838. 00240'01 Final page.
