A bill to amend 1979 PA 94, entitled "The state school aid act of 1979," by amending sections 11 and 97 (MCL 388.1611 and 388.1697), sec- tion 11 as amended and section 97 as added by 2000 PA 297. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 11. (1)For the fiscal year ending September 30,22000, there is appropriated for the public schools of this state3and certain other state purposes relating to education the sum of4$9,623,215,800.00 from the state school aid fund established by5section 11 of article IX of the state constitution of 1963 and6the sum of $420,613,500.00 from the general fund.For the fiscal 7 year ending September 30, 2001, there is appropriated for the 8 public schools of this state and certain other state purposes 9 relating to education the sum of $10,402,821,500.00 from the 10 state school aid fund established by section 11 of article IX of 03378'01 TAV 2 1 the state constitution of 1963 and the sum of $385,613,500.00 2 from the general fund. For the fiscal year ending September 30, 3 2002, there is appropriated for the public schools of this state 4 and certain other state purposes relating to education the sum of 5 $11,192,489,800.00 from the state school aid fund established by 6 section 11 of article IX of the state constitution of 1963 and 7 the sum of $205,613,500.00 from the general fund. For the fiscal 8 year ending September 30, 2003, there is appropriated for the 9 public schools of this state and certain other state purposes 10 relating to education the sum of $11,339,360,300.00 from the 11 state school aid fund established by section 11 of article IX of 12 the state constitution of 1963 and the sum of $420,613,500.00 13 from the general fund. In addition, available federal funds are 14 appropriated for each of those fiscal years. 15 (2) The appropriations under this section shall be allocated 16 as provided in this act. Money appropriated under this section 17 from the general fund and from available federal funds shall be 18 expended to fund the purposes of this act before the expenditure 19 of money appropriated under this section from the state school 20 aid fund. If the maximum amount appropriated under this section 21 from the state school aid fund for a fiscal year exceeds the 22 amount necessary to fully fund allocations under this act from 23 the state school aid fund, that excess amount shall not be 24 expended in that state fiscal year and shall not lapse to the 25 general fund, but instead shall remain in the state school aid 26 fund. 03378'01 3 1 (3) If the maximum amount appropriated under this section 2 and section 11f from the state school aid fund for a fiscal year 3 exceeds the amount available for expenditure from the state 4 school aid fund for that fiscal year, payments under sections 5 11f, 11g, 22a, 31d, 51a(2), and 51c shall be made in full and 6 payments under each of the other sections of this act shall be 7 prorated on an equal percentage basis as necessary to reflect the 8 amount available for expenditure from the state school aid fund 9 for that fiscal year. However, if the department of treasury 10 determines that proration will be required under this subsection, 11 the department of treasury shall notify the state budget direc- 12 tor, and the state budget director shall notify the legislature 13 at least 30 calendar days or 6 legislative session days, which- 14 ever is more, before the department reduces any payments under 15 this act because of the proration. During the 30 calendar day or 16 6 legislative session day period after that notification by the 17 state budget director, the department shall not reduce any pay- 18 ments under this act because of proration under this subsection. 19 The legislature may prevent proration from occurring by, within 20 the 30 calendar day or 6 legislative session day period after 21 that notification by the state budget director, enacting legisla- 22 tion appropriating additional funds from the general fund, 23 countercyclical budget and economic stabilization fund, state 24 school aid fund balance, or another source to fund the amount of 25 the projected shortfall. 26 (4) Except for the allocation under section 26a, any general 27 fund allocations under this act that are not expended by the end 03378'01 4 1 of the state fiscal year are transferred to the state school aid 2 fund. 3 Sec. 97. (1) From the state school aid fund money appropri- 4 ated in section 11 FOR 1999-2000, there is allocated an amount 5 not to exceed $110,000,000.00 for 1999-2000 only for payments to 6 districts for the teacher technology initiative. 7 (2) From the allocation under subsection (1), there is allo- 8 cated to each district an amount per eligible teacher not to 9 exceed $1,200.00, or the actual cost, whichever is less, to pro- 10 vide 1 or more of the following: 11 (a) A computer and remote internet access for the use of 12 each eligible teacher, or a certificate redeemable for a computer 13 and remote internet access. A district shall acquire computers 14 and remote internet access for eligible teachers in a manner 15 approved by the department of management and budget and the 16 Michigan virtual university in order to qualify for funding under 17 this section. 18 (b) If agreed to by a majority vote of the school building's 19 teaching staff who would otherwise receive a computer under this 20 section, with the concurrence of the school building's adminis- 21 tration, 1 or more of the following: 22 (i) Building-level or classroom-level technology 23 improvements. 24 (ii) Teacher professional development in technology. 25 (3) Funding to a district under this section shall be allo- 26 cated as follows: 03378'01 5 1 (a) A maximum of 10% shall be paid based on the number of 2 classroom teachers employed by the district, as certified by the 3 district in a manner prescribed by the department of management 4 and budget. To be eligible to receive additional payments under 5 this section and to avoid a deduction of the payment under this 6 subdivision in a subsequent state school aid payment, a district 7 must certify that not less than 10% of its teachers are eligible 8 teachers under subsection (4). 9 (b) The remainder of the allocation shall be paid to a dis- 10 trict with the next available state school aid payment calculated 11 after the district certifies to the department of management and 12 budget the eligibility of its teachers under subsection (4). 13 (4)AnFOR A DISTRICT, AN eligible teacher is a teacher 14 who is employed full-time in an elementary or secondary school 15 operated by a district, who is providing classroom instruction, 16 and who is certified by the district as meeting all of the 17 following: 18 (a) Meets the minimum technology competencies identified by 19 the Michigan virtual university. 20 (b) Has completed an assessment prescribed by the Michigan 21 virtual university of his or her technology literacy and will 22 take a follow-up assessment within 1 year after receiving a 23 computer. 24 (c) Develops a document that briefly describes how he or she 25 plans to use the computer to enhance his or her own professional 26 growth and teaching. This document is to be retained within the 27 teacher's professional file. 03378'01 6 1 (d) Agrees in writing to comply with the teacher technology 2 initiative fair use policy and with a policy concerning teachers 3 who cease to be eligible teachers, as prescribed by the depart- 4 ment of management and budget and the Michigan virtual 5 university. 6 (5) IF, AS OF JUNE 1, 2001, THERE ARE FUNDS APPROPRIATED 7 UNDER THIS SECTION FOR 1999-2000 THAT HAVE NOT BEEN ALLOCATED TO 8 DISTRICTS, THOSE REMAINING FUNDS ARE APPROPRIATED FOR THE 9 2000-2001 FISCAL YEAR AND ARE ALLOCATED FOR THE PURPOSES OF THIS 10 SUBSECTION. FROM THIS ALLOCATION, THERE IS ALLOCATED TO EACH 11 INTERMEDIATE DISTRICT AN AMOUNT PER ELIGIBLE TEACHER NOT TO 12 EXCEED $1,200.00, OR THE ACTUAL COST, WHICHEVER IS LESS, TO PRO- 13 VIDE 1 OR MORE OF THE FOLLOWING: 14 (A) A COMPUTER AND REMOTE INTERNET ACCESS FOR THE USE OF 15 EACH ELIGIBLE TEACHER, OR A CERTIFICATE REDEEMABLE FOR A COMPUTER 16 AND REMOTE INTERNET ACCESS. AN INTERMEDIATE DISTRICT SHALL 17 ACQUIRE COMPUTERS AND REMOTE INTERNET ACCESS FOR ELIGIBLE TEACH- 18 ERS IN A MANNER APPROVED BY THE DEPARTMENT OF MANAGEMENT AND 19 BUDGET AND THE MICHIGAN VIRTUAL UNIVERSITY IN ORDER TO QUALIFY 20 FOR FUNDING UNDER THIS SUBSECTION. 21 (B) IF AGREED TO BY A MAJORITY VOTE OF THE SCHOOL BUILDING'S 22 OR PROGRAM'S TEACHING STAFF WHO WOULD OTHERWISE RECEIVE A COM- 23 PUTER UNDER THIS SUBSECTION, WITH THE CONCURRENCE OF THE SCHOOL 24 BUILDING'S ADMINISTRATION, 1 OR MORE OF THE FOLLOWING: 25 (i) BUILDING-LEVEL OR CLASSROOM-LEVEL TECHNOLOGY 26 IMPROVEMENTS. 03378'01 7 1 (ii) TEACHER PROFESSIONAL DEVELOPMENT IN TECHNOLOGY. 2 (6) FUNDING TO AN INTERMEDIATE DISTRICT UNDER SUBSECTION (5) 3 SHALL BE ALLOCATED AS FOLLOWS: 4 (A) A MAXIMUM OF 10% SHALL BE PAID BASED ON THE NUMBER OF 5 CLASSROOM TEACHERS EMPLOYED BY THE INTERMEDIATE DISTRICT, AS CER- 6 TIFIED BY THE INTERMEDIATE DISTRICT IN A MANNER PRESCRIBED BY THE 7 DEPARTMENT OF MANAGEMENT AND BUDGET. TO BE ELIGIBLE TO RECEIVE 8 ADDITIONAL PAYMENTS UNDER THIS SECTION AND TO AVOID A DEDUCTION 9 OF THE PAYMENT UNDER THIS SUBDIVISION IN A SUBSEQUENT STATE 10 SCHOOL AID PAYMENT, AN INTERMEDIATE DISTRICT MUST CERTIFY THAT 11 NOT LESS THAN 10% OF ITS TEACHERS ARE ELIGIBLE TEACHERS UNDER 12 SUBSECTION (7). 13 (B) THE REMAINDER OF THE ALLOCATION SHALL BE PAID TO AN 14 INTERMEDIATE DISTRICT WITH THE NEXT AVAILABLE STATE SCHOOL AID 15 PAYMENT CALCULATED AFTER THE INTERMEDIATE DISTRICT CERTIFIES TO 16 THE DEPARTMENT OF MANAGEMENT AND BUDGET THE ELIGIBILITY OF ITS 17 TEACHERS UNDER SUBSECTION (7). 18 (7) FOR AN INTERMEDIATE DISTRICT, AN ELIGIBLE TEACHER IS A 19 TEACHER WHO IS EMPLOYED FULL-TIME IN AN ELEMENTARY OR SECONDARY 20 SCHOOL OR PROGRAM OPERATED BY THE INTERMEDIATE DISTRICT, WHO IS 21 PROVIDING CLASSROOM INSTRUCTION, AND WHO IS CERTIFIED BY THE 22 INTERMEDIATE DISTRICT AS MEETING ALL OF THE FOLLOWING: 23 (A) MEETS THE MINIMUM TECHNOLOGY COMPETENCIES IDENTIFIED BY 24 THE MICHIGAN VIRTUAL UNIVERSITY. 25 (B) HAS COMPLETED AN ASSESSMENT PRESCRIBED BY THE MICHIGAN 26 VIRTUAL UNIVERSITY OF HIS OR HER TECHNOLOGY LITERACY AND WILL 03378'01 8 1 TAKE A FOLLOW-UP ASSESSMENT WITHIN 1 YEAR AFTER RECEIVING A 2 COMPUTER. 3 (C) DEVELOPS A DOCUMENT THAT BRIEFLY DESCRIBES HOW HE OR SHE 4 PLANS TO USE THE COMPUTER TO ENHANCE HIS OR HER OWN PROFESSIONAL 5 GROWTH AND TEACHING. THIS DOCUMENT IS TO BE RETAINED WITHIN THE 6 TEACHER'S PROFESSIONAL FILE. 7 (D) AGREES IN WRITING TO COMPLY WITH THE TEACHER TECHNOLOGY 8 INITIATIVE FAIR USE POLICY AND WITH A POLICY CONCERNING TEACHERS 9 WHO CEASE TO BE ELIGIBLE TEACHERS, AS PRESCRIBED BY THE DEPART- 10 MENT OF MANAGEMENT AND BUDGET AND THE MICHIGAN VIRTUAL 11 UNIVERSITY. 12 (8)(5)The department of management and budget shall 13 develop a policy concerning equitable reimbursement by an eligi- 14 ble teacher who ceases to be eligible after receipt of a computer 15 under this section. 16 (9)(6)Funds allocated under this section that are not 17 expended in the state fiscal year for which they were allocated 18 may be carried forward to the next 2 subsequent state fiscal 19 years. 03378'01 Final page.
