A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1233 (MCL 380.1233), as amended by 2000 PA 288. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1233. (1) Except as otherwise provided by law, the 2 board of a school district or intermediate school board of an 3 intermediate school district shall not permit a teacher who does 4 not hold a valid teaching certificate to teach in a grade or 5 department of the school. 6 (2) The board of a school district or intermediate school 7 board of an intermediate school district shall not allow an indi- 8 vidual to serve in a counseling role in the school district or 9 intermediate school district, as the role is defined by the 10 superintendent of public instruction, unless the individual meets 02183'01 TAV 2 1 1 or more of the following and the board or intermediate school 2 board complies with subsection (7): 3 (a) The individual holds a valid teaching certificate with a 4 school counseling endorsement. 5 (b) The individual meets all of the following: 6 (i) Holds a master's degree awarded after completion of an 7 approved school counselor education program that includes at 8 least all of the following skills and content areas or their 9 equivalent: 10 (A) Guidance services--philosophy, principles, and 11 practices. 12 (B) Individual and group analysis--nature and range of human 13 characteristics and appraisal methods. 14 (C) Guidance information--vocational development theory, 15 educational and occupational information. 16 (D) Counseling theory and practice--individual and group 17 procedures, administration and coordination relationships, pro- 18 fessional relationships, and ethics. 19 (E) Supervised experiences--laboratory, practicum, or 20 internship. 21 (F) Evaluation--statistics and research methodology, 22 follow-up evaluation, and measurement methods. 23 (ii) Has successfully completed the department's guidance 24 counselor examination. 25 (iii) Has been recommended by an approved school counselor 26 education program to provide services as a school counselor. 02183'01 3 1 (c) The individual meets both of the following: 2 (i) Has at least 5 years of successful experience serving in 3 a school counseling role in another state within the immediately 4 preceding 7-year period. 5 (ii) Has successfully completed the department's guidance 6 counselor examination. 7 (3) The intermediate superintendent shall notify the super- 8 intendent of public instruction immediately of the names of non- 9 certificated teachers teaching in violation of subsection (1) and 10 the names of individuals serving in counseling roles in violation 11 of subsection (2), the employing district, and the amount of time 12 the noncertificated teachers or unqualified individuals were 13 employed. 14 (4) A vocational teacher preparation institution shall uti- 15 lize the employment experience of an annually authorized teacher 16 for the purpose of waiving student teaching as a requirement for 17 vocational certification if the annually authorized teacher is 18 supervised by the teacher preparation institution. 19 (5) All vocational education teachers certified after 20 June 1, 1995 shall pass a competency test. 21 (6) The board of a school district or intermediate school 22 district may employ a person without a teaching certificate as a 23 substitute teacher if the person has at least 90 semester hours 24 of college credit from a college or university. AS USED IN THIS 25 SUBSECTION, "COLLEGE" INCLUDES AN ACCREDITED COMMUNITY COLLEGE 26 LOCATED IN THIS STATE. 02183'01 4 1 (7) If the board of a school district or intermediate school 2 board of an intermediate school district chooses to employ an 3 individual who does not hold a valid teaching certificate to 4 serve in a counseling role, as permitted under subsection (2), 5 the school board or intermediate school board shall comply with 6 sections 1230 and 1230a with respect to that individual to the 7 same extent as required for employing a person with a teaching 8 certificate to serve as a teacher. 02183'01 Final page.
