A SUMMARY OF HOUSE BILL 5455 AS INTRODUCED 11-27-01
House Bill 5455 would amend Public Act 51 of 1951, the Michigan Transportation Fund Act, to specify require warranties on the repair and new construction of road and bridge projects. Under the bill, the warranty program would be repealed 10 years after it was enacted.
More specifically and under the bill, beginning with contracts entered into one year after the effective date of the bill, the Department of Transportation, all county road commissions, and all cities and villages would be required to have a three-year repair warranty on road and bridge maintenance projects, and a five-year full replacement warranty on new road and bridge construction projects. The bill specifies that the department would establish standards necessary for the warranties within one year after the effective date of bill. Further, the department would be required to review and evaluate the effectiveness of the warranties within seven years after the effective date of the bill, and then to report its findings and recommendations to the Transportation Appropriations Subcommittees of the House and Senate, and to the House and Senate Fiscal Agencies.
