A SUMMARY OF HOUSE BILL 5310 AS INTRODUCED 10-23-01

Under the Worker's Disability Compensation Act, benefits payable under the act are reduced by certain specified amounts if the injured employee receives old-age insurance benefits or certain employer-paid benefits during the time period he or she is eligible to receive benefits under the act. Currently, for those injured employees receiving benefits under the Social Security Act, the employer's weekly contribution is reduced by 50 percent of the amount of the old-age insurance benefits received from Social Security. House Bill 5310 would specify that the weekly benefits payable after this reduction could not be less than 50 percent of the weekly benefits that would be otherwise payable without the reduction.
