A SUMMARY OF HOUSE BILLS 5016 AND 5017 AS INTRODUCED 7-10-01

House Bill 5016 would amend the Stille-DeRossett-Hale Single State Construction Code Act (MCL 125.1513e) to require the State Construction Code Commission and the Department of Consumer and Industry Services to adopt standards pursuant to rules promulgated under the Administrative Procedures Act regarding requirements for air conditioning or ceiling fans, or both, in the rooms of nursing home residents. The bill says that the rules could provide for different standards for existing and newly built structures. The commission could incorporate the rules into the next mechanical code update. Under the bill, nursing homes would be required to comply with the proposed rules beginning June 1, 2002.

House Bill 5017 would amend the Public Health Code (MCL 333.20144a) to specify that a nursing home that did not comply with the requirements imposed under House Bill 5016 would be in violation of the code.

The bills are tie-barred to each other; one could not take effect unless the other were also enacted.
