A SUMMARY OF HOUSE BILLS 4514 AND 4515 AS INTRODUCED 3-22-01
House Bill 4514 would repeal a provision of the Michigan Penal Code (MCL 750.348) that makes it a felony to incite an Indian nation, tribe, chief, or individual to violate peace treaties with other Indian nations or tribes, or the United States, or to incite these persons to disturb the peace and tranquility that exists between an Indian nation or tribe and another Indian nation, tribe, or the United States; or to incite or attempt to incite such persons to violate any state or federal law.
House Bill 4515 would amend the Code of Criminal Procedure (MCL 777.16q) to delete the corresponding sentencing guideline for a violation of MCL 750.348 (inciting an Indian to violate a treaty).
