A SUMMARY OF HOUSE BILL 4465 AS INTRODUCED 3-14-01
Public Act 437 of 2000 requires homes for the aged and nursing homes to offer each resident, or provide each resident with information and assistance in obtaining, an annual vaccination against influenza. House Bill 4465 would amend the Public Health Code to require these facilities to assure that their residents are vaccinated, with certain exceptions.
Under the bill, a nursing or home for the aged would have to assure that each resident received a flu vaccine between November 15 and December 15 of each year. A resident admitted between December 15 and April 1 of the following year would have to be vaccinated at the time of admission. However, a resident could not be vaccinated if the resident or a family member presented a written statement that the vaccine was contrary to the resident's religious or other beliefs, or was medically inappropriate. Each vaccination, and each waiver, would have to be entered into a resident's permanent medical record.
