Under the Food Law of 2000, the Department of Agriculture or a local health department is required to perform unannounced health compliance inspections of each "food service establishment." A "food service establishment" is an eating or drinking establishment or operation where food is prepared for direct consumption by, served to, or otherwise provided for the public. Upon completion of the inspection, the inspector must issue a report identifying any conditions considered to be critical from a public health standpoint and summarizing other findings concerning the establishment's compliance with the requirements of the Food Law of 2000.
House Bill 4464 would amend the Food Law of 2000 (MCL 289.3128)) to require that food service establishments provide a customer with a copy of the report issued upon completion of the most recent compliance inspection, at the customer's request. If the owner or operator of the establishment requested a review of the report, he or she would be permitted to note the request on the customer's copy of the report. The owner or operator of the establishment would also be required to post a notice informing customers of their right to a copy of the compliance inspection report. The notice would have to be posted in a conspicuous place and printed on paper at least 11 inches x 17 inches in size, and the text of the notice would have to be in at least 32-point boldfaced type.
