A SUMMARY OF HOUSE BILL 4417 AS INTRODUCED 3-6-01

Under provisions of the Michigan Liquor Control Code, a vendor (which includes retail licensees and wholesalers of beer and wine) is prohibited from giving away alcohol of any kind or description in connection with his or her business. The bill would make an exception to this prohibition by allowing an on-premises licensee to offer and award his or her employees with unopened alcoholic liquor in a sealed container as a gift or as a prize for any activity that is allowed under the code or commission rules. However, any bottle or container of alcohol given as a gift or award under the bill could not be consumed on the licensed premises, and the employee receiving the alcohol would have to be at least 21 years of age.

Further, the bill would specify that an on-premises licensee could give a sampling or tasting of alcohol to his or her employee for the express purpose of educating the employee regarding types of alcohol as long as the employee were at least 21 years of age.
