A SUMMARY OF HOUSE BILL 4035 AS INTRODUCED 1-25-01
Generally, under the Michigan Liquor Control Code, a retail licensee cannot be charged with a violation involving selling or furnishing alcohol to an underage person unless enforcement action is also taken against the underage person, and if applicable, against the person of drinking age who furnished the alcohol to the underage person. The bills would amend two sections of the code containing this provision to clarify that the provision would also include a liquor licensee's clerk, agent, or employee. In other words, under the bills, a retail licensee could not be charged with a violation unless enforcement action was also taken against the minor and the person who furnished the liquor to the minor, including the licensee's clerk, agent, or employee.
