A bill to amend 1964 PA 170, entitled "An act to make uniform the liability of municipal corporations, political subdivisions, and the state, its agencies and departments, officers, employees, and volunteers thereof, and members of certain boards, councils, and task forces when engaged in the exercise or discharge of a governmental function, for injuries to property and persons; to define and limit this liability; to define and limit the liability of the state when engaged in a proprietary function; to authorize the purchase of liability insurance to protect against loss arising out of this liability; to provide for defending certain claims made against public officers and paying damages sought or awarded against them; to provide for the legal defense of public officers and employees; to provide for reimbursement of public officers and employees for certain legal expenses; and to repeal certain acts and parts of acts," by amending the title and sections 8 and 9 (MCL 691.1408 and 691.1409), the title as amended by 1986 PA 175.

Reps. Kolb and Minore, having reserved the right to explain their protest against the passage of the bill, made the following statement:
"Mr. Speaker and members of the House:
The entire package of bills requires physicians, under threat of felony penalties, to arrange for the administration of emergency care whenever an abortion ends in a 'live birth.' Under the bills, a 'live birth' is deemed to have occurred if there are 'any signs of life' after expulsion or extraction, regardless of the stage of gestation. This can presumably include the pulsation of the umbilical cord, or similar occurrences, after a first-trimester abortion even when there is no chance of viability or survival. The bills' emergency care requirement would thus apply even in such cases.If the termination was performed in a hospital. the attending physician would be required to request an additional 'resident, on-duty, or emergency physician' to provide medical care. If the termination took place outside of a hospital, as is common, the attending physician is required to call 9-1-1 to arrange for an emergency transfer to a hospital. Such a transfer is required, again, wholly without regard to viability. The issue of survival is considered only after the transfer is completed. Following this transfer of care, 'life sustaining medical treatment' must be administered unless the fetus 'is determined to have no chance of survival due to gestational immaturity.' In the latter case, the emergency service provider must provide 'humane comfort care,' which is undefined. Requiring additional and duplicative personnel to administer emergency care in the case of every 'live birth' of a fetus is unnecessary and a misuse of limited emergency medical resources. Moreover, these bills are unnecessary: physicians are already legally obligated to administer appropriate medical treatment in the case of live births.These bills create a situation in which a woman who had made the difficult choice of obtaining an abortion may find herself in a much more difficult--and even dangerous--situation."

A resolution urging the Public Service Commission to investigate and take appropriate action regarding calling arrangements between communities situated on the Straits of Mackinac.
Whereas, Residents who live or work in communities situated on the Straits of Mackinac encounter situations where calls between the mainland and islands are categorized as interLATA long distance calls and may incur higher charges than if they were local calls; and
Whereas, When such calls traverse boundaries between Local Access and Transport Areas (LATAs), not all providers are permitted to carry such calls. For example, calls between Mackinac Island and Mackinaw City cross LATA boundaries; thus, the local telephone exchange company may not lawfully carry such calls under current federal mandates; and
Whereas, Island communities are frequently linked to the mainland by close bonds of commerce, tourism, geography, and recreation, which can depend upon telecommunications for their vitality; and
Whereas, Island communities may thus be within a community of interest with those on the mainland, justifying the Public Service Commission to direct telecommunications providers to file petitions with the Federal Communications Commission seeking waivers of LATA restrictions for the purpose of providing extended local calling service between such communities; and
Whereas, The market for telecommunications calling continues to experience competitive growth, providing more choices for consumers and rate plans designed to meet consumer needs. Consequently, competition, including wireless telephones, may provide solutions for the calling arrangements of island communities; now, therefore be it
Resolved by the House of Representatives, That we urge the Michigan Public Service Commission to take appropriate action regarding interLATA calling arrangements between islands and the mainland in the Straits of Mackinac for the purpose of providing extended local calling service between such communities; and be it further
Resolved, That we urge the Federal Communications Commission to support waivers of LATA restrictions for the purpose of providing extended local calling service between these communities; and be it further
