"An act to revise, consolidate, and codify the laws relating to criminal procedure and to define the jurisdiction, powers, and duties of courts, judges, and other officers of the court under the provisions of this act; to provide laws relative to the rights of persons accused of criminal offenses and ordinance violations; to provide for the arrest of persons charged with or suspected of criminal offenses and ordinance violations; to provide for bail of persons arrested for or accused of criminal offenses and ordinance violations; to provide for the examination of persons accused of criminal offenses; to regulate the procedure relative to grand juries, indictments, informations, and proceedings before trial; to provide for trials of persons complained of or indicted for criminal offenses and ordinance violations and to provide for the procedure in those trials; to provide for judgments and sentences of persons convicted of criminal offenses and ordinance violations; to establish a sentencing commission and to prescribe its powers and duties; to provide for procedure relating to new trials and appeals in criminal and ordinance violation cases; to provide a uniform system of probation throughout this state and the appointment of probation officers; to prescribe the powers, duties, and compensation of probation officers; to provide penalties for the violation of the duties of probation officers; to provide for procedure governing proceedings to prevent crime and proceedings for the discovery of crime; to provide for fees of officers, witnesses, and others in criminal and ordinance violation cases; to set forth miscellaneous provisions as to criminal procedure in certain cases; to provide penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act,".

Rep. Drolet, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

House Bill 5364 would impose a $7500 fine on those who practice capitalism without a license. Ronald Reagan once complained that government's hostility toward capitalism could be condensed down to three rules:

 

(1) If it moves ­ tax it.

(2) If it keeps moving ­ regulate it.

(3) If it stops moving ­ subsidize it.

 

This bill follows from rule #2: the compulsion to regulate commerce when it is working too well. At present, there are willing car sellers and buyers who conduct business every day without either party obtaining an auto dealer license. Nearly all Michigan citizens have sold and bought cars without a license, or know someone who has. This proposal would slap an unprecedented fine on unlicensed car sellers who sell too many cars. Michigan has been the car capitol of the world for nearly 100 years, and we seem to have always assumed that this free exchange of cars was an acceptable means of trading a product that we know very well. But now, the dead hand of state government has discovered this corner of the economy that works independent of its guidance, and has arrived to throw down some rules and penalties.

Consumers had best grab for their wallets, because there is something sinister at work here. We should always be suspicious whenever a politician, bureaucrat, or trade group agitates for requiring a new "license" to practice what before was a free economic activity. The watchword should be the question: Who gains? The answer in this case is most assuredly not the consumer. Some unregulated car dealers will look upon this new law, decide against the license, and stop selling cars. Consumers will be robbed of a willing seller, and the law of supply and demand will run its course. Purchasing options will go down. Prices will rise.

One day, another Ronald Reagan will come along and ask us how we ever created a world with so many rules, so few choices, and such high prices. When that question is asked, this legislation will be a small part of the answer."

"An act to codify the laws relating to the laying out of drainage districts, the consolidation of drainage districts, the construction and maintenance of drains, sewers, pumping equipment, bridges, culverts, fords, and the structures and mechanical devices to properly purify the flow of drains; to provide for flood control projects; to provide for water management, water management districts, and subdistricts, and for flood control and drainage projects within drainage districts; to provide for the assessment and collection of taxes; to provide for the investment of funds; to provide for the deposit of funds for future maintenance of drains; to authorize public corporations to impose taxes for the payment of assessments in anticipation of which bonds are issued; to provide for the issuance of bonds by drainage districts and for the pledge of the full faith and credit of counties for payment of the bonds; to authorize counties to impose taxes when necessary to pay principal and interest on bonds for which full faith and credit is pledged; to validate certain acts and bonds; and to prescribe penalties,".

If the results of treatment do not meet or exceed the treatment target goals within a time frame currently accepted as medical standard of care in the treatment and management of glaucoma, the optometrist shall further consult with an ophthalmologist regarding further diagnosis and possible treatment.".

(2) AN OPTOMETRIST WHO IS SUBJECT TO SUBSECTION (1) SHALL MEET THE CONTINUING EDUCATION REQUIREMENTS DESCRIBED IN SUBSECTION (1) WITHIN 1 YEAR AFTER ENGAGING IN 1 OR MORE OF THE ACTIVITIES DESCRIBED IN SUBSECTION (1). THE OPTOMETRIST SHALL MEET THOSE CONTINUING EDUCATION REQUIREMENTS AS LONG AS HE OR SHE ENGAGES IN 1 OR MORE OF THE ACTIVITIES DESCRIBED IN SUBSECTION (1).".

(2) As required under section 16204, the board shall promulgate rules requiring each applicant for license renewal to complete as part of the education program required under subsection (1) an appropriate number of hours or courses in pain and symptom management.".

A resolution honoring the Cato Institute upon the occasion of their 25th anniversary.

Whereas, It is with deep appreciation of the significance of this milestone that we commend the members and staff of the Cato Institute as they mark the 25th anniversary of the founding of this exemplary educational organization. We are proud to recognize the important role that this organization has played in contributing to furthering the principles of the American Revolution throughout the United States and the world. These principles are individual liberty, limited government, free market, and the rule of law; and

Whereas, Since its founding, the Cato Institute has become a vital element in growing and adapting the principles of the Founding Fathers to the current social and cultural debate. Doing this has helped further the traditional American principles of limited government, individual liberty, free markets, and peace; and

Whereas, The Cato Institute's success in adhering to its mission during an era of many cultural and social challenges is the direct result of the commitment of the Institute's founder, Edward H. Crane, and other supporters of the organization. Their ability to work together has developed an environment that breeds high-quality intellectual analysis of complex social issues; and

Whereas, The Cato Institute has been a home of rational individualism and a home for rational individualists; and

Whereas, Many market-oriented solutions that have been implemented, or are currently being discussed, would not have been possible without the work of the Cato Institute; and

Whereas, In looking back over the 25 years of the Cato Institute's history, it is clear that the Institute has set its course with a continuing look towards the future. The vision to which the Institute adheres, brings the wisdom of the American Founders to bear on the problems of today. As did the Founders, the Institute looks to the future with optimism and excitement, eager to discover what great things women and men will do in the coming century. We are grateful for all that the Cato Institute has contributed to the free-market movement in Michigan and around the world; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body honor the Cato Institute upon the occasion of their 25th anniversary. A resolution honoring the life of Ruth Gertrude Marcus.

Whereas, It is with deep compassion for the family of Ruth Gertrude Marcus that we offer our sympathy for their loss and our appreciation for the hard work, dedication, and professionalism that Ruth Marcus put forth on behalf of the people of Muskegon County over her lifetime. As we look back on Ms. Marcus' life, we recognize the loyalty and devotion to public service of this conscientious individual and we add our sentiments of gratitude for a job well-done; and

Whereas, In over 50 years of involvement in politics, Ms. Marcus proved herself deeply committed to bettering the Muskegon community. She served as vice-chairwoman of the Young Democrats in 1949 and was heavily engaged in local Democratic politics. As Ruth Marcus well knew, participation in the process is critical to improving the quality of life for all; and

Whereas, Ruth Marcus was the first woman chairperson of Muskegon Community College and a 24-year member of Muskegon Community College's board. She brought a refreshing perspective to Muskegon Community College and its board and sensitized them to the needs of women, single parents, and the minority community; and

Whereas, Committed to enhancing the plight of women, the young, poor, and the oppressed, Ms. Marcus was active in the League of Women Voters, local chapter of the National Organization for Women, and the Older Women's League. She also served on the boards of Greater Muskegon Adult Education Association, Community Mental Health Services, United Nations Association, Every Woman's Place, and the Muskegon Area Planned Parenthood, as well as, a state task force examining sexism in schools during the mid-1970s; and

Whereas, Through her personal sense of duty and strong convictions that defined her public service career, Ms. Marcus proved herself a worthy role model for current and future community leaders to emulate. This has been deeply appreciated, both by citizens and organizations in Muskegon County that have benefited directly from Ruth Marcus' work, as well as, other public servants who have witnessed this fine example; and

Whereas, There can be little doubt that Ruth Marcus impacted the Muskegon community in very positive ways. We offer our condolences and appreciation to Ms. Marcus' family; now, therefore, be it

A resolution congratulating Frederick and Janet Shinavier on the occasion of their 40th wedding anniversary.

Whereas, It is a distinct honor to join with the family and friends of Fred and Jan Shinavier of Lake Orion, Michigan, as they celebrate their 40th wedding anniversary. As they gather to mark this milestone in their lives, it is most appropriate to commend Fred and Jan for the manner in which their strong relationship has enhanced our state and has enriched the lives of all who are fortunate enough to know these two fine people; and

Whereas, On May 19, 1962, Fred and Jan joined their dreams and hearts together. For Fred and Jan, it was a time of commitment as they pledged their love and future to one another at Our Lady of Lourdes Church in River Rouge, Michigan. Through their hard work in the years that followed, including Fred's thirty-two years with General Motors and Jan's work at Burroughs Corporation and Ross Chemical, they helped to build Michigan and our country. When not working, Fred and Jan fill their time with leisure activities. Fred enjoys hunting, fishing, boating, and playing hockey and golf. Jan has won numerous ribbons for her porcelain dolls and teaches classes on the subject. She also enjoys casino gaming and playing bingo; and

Whereas, Since they pledged their trust, respect, and affection in marriage, Fred and Jan have also witnessed changes in their own lives. Their love and commitment has produced a loving family. Their three sons, Dean, Mark, and Gary and four grandchildren, Ryan, Shelby, Cameron, and Andrew exemplify the rewards of a wonderful marriage. As Fred and Jan savor the remembrances of the years they have shared, they will fondly recall the rich and full life they have known as a couple and as parents. Together, they have cherished the joys and faced the challenges of raising children. As they mark this day, may they also know that they have set an example for our entire state; and

Whereas, As the Shinaviers reflect upon their 40 years together, they must fondly recall the day they met. While they could not have known what the future would bring, they knew they would stand by each other. They have certainly done that and have demonstrated the rewards of a happy marriage; and

Whereas, Clearly, the Shinaviers share many interests, such as helping others, working diligently, and providing a fine example for their children. Together they have experienced much during the last 40 years. Through it all, their relationship has grown closer, their commitment stronger, and their friendship deeper.
