"Heavenly Father, We acknowledge You as our all powerful God and Creator, the Savior of our souls. We thank You for how You have blessed our country. We thank You for the freedom and the democracy that we enjoy. We ask that You would forgive our shortcomings and direct us 'in the paths of righteousness.' We especially ask Your protection upon our military today. Continue to give our President, his administration, and those in Congress wisdom and guidance during this time of distress upon our nation. Lord, we do acknowledge You as the giver of wisdom. I ask that You would give wisdom to each representative here today. Guide them, I pray, in the decisions they make. That each decision that is made would serve to better the lives of those whom they represent. We ask it in the name of our Lord. Amen."

Pursuant to Joint Rule 20, the full title of the act shall be inserted to read as follows:

"An act to revise, consolidate, and codify the laws relating to criminal procedure and to define the jurisdiction, powers, and duties of courts, judges, and other officers of the court under the provisions of this act; to provide laws relative to the rights of persons accused of criminal offenses and ordinance violations; to provide for the arrest of persons charged with or suspected of criminal offenses and ordinance violations; to provide for bail of persons arrested for or accused of criminal offenses and ordinance violations; to provide for the examination of persons accused of criminal offenses; to regulate the procedure relative to grand juries, indictments, informations, and proceedings before trial; to provide for trials of persons complained of or indicted for criminal offenses and ordinance violations and to provide for the procedure in those trials; to provide for judgments and sentences of persons convicted of criminal offenses and ordinance violations; to establish a sentencing commission and to prescribe its powers and duties; to provide for procedure relating to new trials and appeals in criminal and ordinance violation cases; to provide a uniform system of probation throughout this state and the appointment of probation officers; to prescribe the powers, duties, and compensation of probation officers; to provide penalties for the violation of the duties of probation officers; to provide for procedure governing proceedings to prevent crime and proceedings for the discovery of crime; to provide for fees of officers, witnesses, and others in criminal and ordinance violation cases; to set forth miscellaneous provisions as to criminal procedure in certain cases; to provide penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act,".

A bill to amend 1948 (1st Ex Sess) PA 31, entitled "An act to provide for the incorporation of authorities to acquire, furnish, equip, own, improve, enlarge, operate, and maintain buildings, automobile parking lots or structures, recreational facilities, stadiums, and the necessary site or sites therefor, together with appurtenant properties and facilities necessary or convenient for the effective use thereof, for the use of any county, city, village, or township, or for the use of any combination of 2 or more counties, cities, villages, or townships, or for the use of any school district and any city, village, or township wholly or partially within the district's boundaries, or for the use of any school district and any combination of 2 or more cities, villages, or townships wholly or partially within the district's boundaries, or for the use of any intermediate school district and any constituent school district or any city, village, or township, wholly or partially within the intermediate school district's boundaries; to provide for compensation of authority commissioners; to permit transfers of property to authorities; to authorize the execution of contracts, leases, and subleases pertaining to authority property and the use of authority property; to authorize incorporating units to impose taxes without limitation as to rate or amount and to pledge their full faith and credit for the payment of contract of lease obligations in anticipation of which bonds are issued by an authority; to provide for the issuance of bonds by such authorities; to validate action taken and bonds issued; to provide other powers, rights, and duties of authorities and incorporating units, including those for the disposal of authority property; and to prescribe penalties and provide remedies," (MCL 123.951 to 123.965) by adding section 11l.

A resolution honoring the life of Kenneth Hylton, Jr.

Whereas, It is with the deepest sympathy that we mourn the passing of Michigan's citizen, Kenneth Hylton, Jr. During his lifetime, this dedicated attorney, social justice activist, and loving family man devoted his life to fighting for the "little man". He will be genuinely missed and long remembered; and

Whereas, His legacy of compassion and commitment to social justice will be sorely missed. His dedication and conviction was reflected in his ceaseless efforts to improve the lives of those around him; and

Whereas, This concerned citizen also shared his time and talent as a member of countless civic and civil rights organizations. He was a longtime board member of the American Civil Liberties Union of Michigan and Vice Chair of the 15th Congressional District Democratic Party for eight years. In every endeavor during his productive lifetime, Kenneth displayed integrity and dignity; and

Whereas, Kenneth earned much respect and leaves a void that can not be filled. His family bears the greatest loss from his passing, and we offer our condolences to them. Whereas, As the second president of New Detroit, Lawrence coordinated the Detroit Public Schools decentralization plan and later played a key role in the Schools of the 21st Century Initiative. His service on the boards of many community organizations earned him a Distinguished Warrior Award from the Urban League in 2000. Whereas, Veterans served their country in a variety of capacities, acquiring skills which can be used in the civilian workforce. Whereas, Qualified veterans are a wonderful resource for employers throughout Michigan looking to fill their workforce needs. The United States military instills in its members many of the values which are important to employers, such as loyalty, duty, respect, and integrity; and

Whereas, Michigan Works! Service Centers are available statewide to provide employment services to employers and veterans using local veterans employment specialists. The veterans employment specialists can be contacted in person, by phone, and on-line; and

Whereas, The "Michigan Works! for Veterans" campaign honors employers who hire veterans and draws attention to the ongoing services for veterans and employers at the more than 100 Michigan Works! Service Centers throughout the state. The campaign is sponsored by the Michigan Department of Career Development, the Department of Military and Veterans Affairs, and Michigan Works! and it runs from July 4 through November 11, 2001; and

A resolution honoring the Benevolent Protective Order of Elks of the World Sylvan Lake Lodge No. 723 and Crystal Temple No. 435 on the observance of their 75th anniversary in the city of Pontiac.

Whereas, The Elks' Grand Temple was founded in 1902. Today, the entire organization boasts a membership of over 450,000 lodges in the United States, Canada, Mexico, Cuba, West Indies, Virgin Islands, and Panama. In 1926, a local lodge and temple was organized in the city of Pontiac. Charters were then issued and granted by the Grand Lodge and Grand Temple to operate these lodges as Sylvan Lake Lodge No. 723 and Crystal Temple No. 435; and

Whereas, The Elks organization advocates the promotion and enhancement of the welfare and happiness of its members, inculcation of the principles of charity, justice, brotherly/sisterly love, and fidelity, and exaltation of the spirit of patriotism. Through these principles, the organization has enjoyed steady growth and strength; and

Whereas, The Elks have accomplished many of their goals, but many goals have yet to be achieved. The Elks' emphasis is on the youth, not just today, but from the beginning. Through their departments of Education and Civil Liberties, they have advanced the struggle for equal opportunity in every phase of American life. Millions of dollars have been spent on educating the young, regardless of race, creed, or color. Scholarships are given to youths who express the desire to further their talents and skills; and

Whereas, The Elks are involved locally and nationally in community activities. Reps. Jacobs, Kolb, Thomas, Dennis and Clark having reserved the right to explain their protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

This bill will vastly broaden the powers and responsibilities of our legislative sergeants at arms, and any action which expands police powers as this bill does is an action which should be taken with great caution. Nevertheless, this bill has passed through this body this week in great haste, and without sufficient consideration being taken of its potential implications. Too many questions remain unanswered regarding this legislation such as: What would be the chain of command for these officers? (For example, could the House Clerk of a legislative leader or an individual legislator assign these officers to perform certain investigations?) What sort of additional liability would the House or Senate face if a sergeant commissioned as a police officer should act recklessly, and what sorts of protections do we need to take as a body to prevent such from occurring? The goal at hand is to protect the safety of not just legislators, but also the many visitors we have to the Capitol every day. A better way to achieve this goal would be to assign additional existing police officers to the Capitol and the House Office Building."

 

 

Rep. Rivet, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on HB 5341 because it did not recognize the importance of complete and bipartisan oversight of the new enforcement officers it creates. Last session, this bill passed the House and contained the valuable bipartisan provisions. Amendments to that effect failed, keeping the partisan aspect problematic, so I could not support the bill."

THE RULES SHALL NOT INCLUDE ANY REQUIREMENT THAT SEQUENTIAL NUMBERS, BAR CODES, OR SYMBOLS BE AFFIXED, PRINTED, OR WRITTEN ON A PRESCRIPTION FORM OR THAT THE PRESCRIPTION FORM BE A STATE PRODUCED PRESCRIPTION FORM. IN EXAMINING THE NEED FOR RULES FOR THE PRODUCTION OF A PRESCRIPTION FORM ON PAPER THAT MINIMIZES THE POTENTIAL FOR FORGERY, THE DEPARTMENT SHALL CONSIDER AND IDENTIFY THE FOLLOWING:

(A) COST, BENEFITS, AND BARRIERS.

(B) OVERALL COST-BENEFIT ANALYSIS.

(C) COMPATIBILITY WITH THE ELECTRONIC MONITORING SYSTEM REQUIRED UNDER THIS SECTION.

(6) THE DEPARTMENT SHALL REPORT ITS FINDINGS UNDER SUBSECTION (5) TO THE MEMBERS OF THE HOUSE AND SENATE STANDING COMMITTEES HAVING JURISDICTION OVER HEALTH POLICY ISSUES AT LEAST 120 DAYS BEFORE THE TIME THE ELECTRONIC MONITORING SYSTEM REQUIRED UNDER THIS SECTION BECOMES OPERATIONAL." and renumbering the remaining subsections.

A bill to amend 1960 PA 136, entitled "Sale of checks act," by amending sections 2, 12, and 15 (MCL 487.902, 487.912, and 487.915), sections 2 and 12 as amended by 1986 PA 275, and by adding sections 12b, 12c, 12d, 12e, 12f, 12g, and 12h.

The Senate has passed the bill.

The bill was read a first time by its title and referred to the Committee on Commerce.
