A bill to prohibit the use of the name of a state agency or a name similar to the name of a state agency without fair compen- sation; and to provide penalties. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Person" means an individual, partnership, corporation, 3 association, governmental entity, society, or other legal 4 entity. 5 (b) "State agency" means a department, board, commission, 6 office, agency, authority, or other unit of state government. 7 Sec. 2. (1) A person shall not without fair compensation 8 assume, adopt, or use any of the following in the conduct of its 9 business or other activities: 10 (a) The name of a state agency. 00608'99 DAM 2 1 (b) A name that so nearly resembles the name of a state 2 agency as to be an imitation of that name. 3 (c) A name that conveys the false impression that the 4 person's business, products, services, or activities are con- 5 nected with or endorsed, authorized, or approved by a state 6 agency. 7 (2) Subsection (1) does not apply if a state agency gives 8 written permission to use its name without fair compensation. 00608'99 Final page.
