A SUMMARY OF HOUSE BILL 5772 AS INTRODUCED 5-11-00


The bill would amend the Public Health Code to require nursing homes and homes for the aged to ensure that each of their residents receive annual influenza vaccinations, between November 15 and December 15 each year. A resident admitted between December 15 and April 1 of the following year would have to be vaccinated at the time of admission. However, the bill specifies that a nursing home or home for the aged could not vaccinate a resident if the resident or a family member presented a written statement that vaccination was contrary to the resident's religious or other beliefs, or was medically inappropriate. Each vaccination, and each waiver, would have to be entered into a resident's permanent medical record.
