A SUMMARY OF HOUSE BILL 5500 AS INTRODUCED 3-9-00


The bill would amend the Sex Offenders Registration Act to prohibit the publication of any information contained in the registry by anyone other than the Department of State Police (in accordance with the act) or individual registrants. Current law prohibits nonpublic information concerning registration. The bill would also provide that if someone was incorrectly identified as a registered sex offender, that person would have a cause of action against the party responsible for the inaccurate identification. The wrongly identified person could bring a civil cause of action and obtain treble damages. Further, the bill would require the department to correct inaccurate information contained in the registry within seven business days after being notified that the information was inaccurate.
