A SUMMARY OF HOUSE BILL 5464 AS INTRODUCED 2-29-00
The bill would amend the Mental Health Code to prohibit a
recipient of mental health services
from being the subject of experimental treatment unless consent was obtained from one of the
following:
- the recipient, if the person was at least 18 years old and did not
have a guardian for medical
purposes;
- the recipient's parent who had legal and physical custody, if
the recipient was less than 18
years of age;
- the recipient's guardian, if the guardian had power to execute a
consent for medical
treatment; or
- the recipient's designated representative, if a durable power
of attorney or other advance
directive granted the representative authority to consent to medical treatment.
