A SUMMARY OF HOUSE BILL 5121 AS INTRODUCED 11-10-99


The pistol licensing act, Public Act 372 of 1927, MCL 28.421 et al.), prohibits purchasing, carrying, or transporting a pistol in Michigan unless one first obtains a license. House Bill 5121 would amend the act to specify that the prohibition does not apply to a person who loans a pistol to, or who borrows a pistol from, another family member while using the pistol at a firing range. The bill would also delete the current definition of "purchaser" - a person who receives a pistol from another person by purchase, gift, or loan. Instead, the bill would define "purchase" to mean "receipt of a pistol from another person by sale, barter, gift, or loan." Under the bill, "purchase" would not include receiving a pistol from a family member while using the pistol at a firing range.
