AN ACT to amend 1996 PA 202, entitled "An act to authorize the state administrative board to convey certain state owned property in Kalkaska county; to prescribe conditions for the conveyance; and to provide for disposition of the revenue derived from the conveyance," by amending the title and by adding sections 5 and 6.
The People of the State of Michigan enact:
TITLE
An act to authorize the state administrative board to convey certain state owned property in Kalkaska county; to authorize the department of natural resources to convey certain state owned property in Mackinac county; to prescribe conditions for the conveyances; and to provide for disposition of the revenue derived from the conveyances.
Sec. 5. The department of natural resources, on behalf of the state, may convey to the city of St. Ignace, for consideration of $1.00, certain real property under the jurisdiction of the department of natural resources and located in the city of St. Ignace, Mackinac county, Michigan, and more particularly described as:
Lots 6, 7, 8, 9, 10, 11, and 12 of Block 2, Assessor's Plat No. 5, plus the adjoining dock known as the State ferry Dock or Dock No. 1, City of St. Ignace, Mackinac County, Michigan.
Sec. 6. The conveyance authorized by section 5 shall provide for all of the following:
(a) That the property described in section 5 shall be used as part of an exchange for the parcel of property described in section 7, on which a new boat launch facility will be built; and that the exchange shall provide that if any fee, term, or condition for each activity is imposed on members of the public for use of the boat launch, or if any of those fees, terms, or conditions are waived for use of the boat launch, resident and nonresident members of the public shall be subject to the same fees, terms, conditions, or waivers.
(b) The department of natural resources reserves the right to approve the terms of the exchange.
(c) Any difference in value between the exchanged parcels will be used by the city to construct a new boat launch with plans provided by the department of natural resources.
(d) The parcel described in section 5 shall revert back to the state with no liability to the state if, for any reason, the boat launch is not built.
Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 714 of the 89th Legislature is enacted into law.
This act is ordered to take immediate effect.
