HOUSE BILL No. 6132 September 17, 1998, Introduced by Reps. Brewer, Schroer, Brater, Frank, DeHart, Wojno, Scott, Rison, Kilpatrick, Bogardus, Murphy and Parks and referred to the Committee on Advanced Technology and Computer Development. A bill to create the state technology commission within the legislative branch; and to prescribe its powers and duties. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "state technology commission act". 3 Sec. 2. As used in this act, "commission" means the state 4 technology commission created under section 3. 5 Sec. 3. (1) The state technology commission is created 6 within the legislative council. The commission shall exercise 7 its powers and duties, including budgeting, procurement, and 8 other management-related functions, independently of the legisla- 9 tive council. 10 (2) The commission shall consist of 6 members as follows: 11 (a) Two members appointed by the speaker of the house of 12 representatives. 06132'98 JLB 2 1 (b) Two members appointed by the senate majority leader. 2 (c) Two members appointed by the governor. 3 (3) The members first appointed to the commission shall be 4 appointed within 60 days after the effective date of this act. 5 (4) Members of the commission shall serve for terms of 3 6 years or until a successor is appointed, whichever is later, 7 except that of the members first appointed 2 shall serve for 8 1 year, 2 shall serve for 2 years, and 2 shall serve for 9 3 years. 10 (5) If a vacancy occurs among the members on the commission, 11 the vacancy shall be filled in the same manner as the original 12 appointment. 13 (6) At the first meeting, the commission shall elect from 14 among its members a chairperson and other officers as it consid- 15 ers necessary or appropriate. After the first meeting, the com- 16 mission shall meet at least quarterly, or more frequently at the 17 call of the chairperson or if requested by a majority of its 18 members. 19 (7) A majority of the members of the commission constitute a 20 quorum for the transaction of business at a meeting of the 21 commission. A majority of the members present and serving are 22 required for official action of the commission. 23 (8) The business that the commission may perform shall be 24 conducted at a public meeting of the commission held in compli- 25 ance with the open meetings act, 1976 PA 267, MCL 15.261 to 26 15.275. 06132'98 3 1 (9) A writing prepared, owned, used, in the possession of, 2 or retained by the commission in the performance of an official 3 function is subject to the freedom of information act, 1976 4 PA 442, MCL 15.231 to 15.246. 5 (10) Members of the commission shall serve without 6 compensation. However, members of the commission may be reim- 7 bursed for their actual and necessary expenses incurred in the 8 performance of their official duties as members of the 9 commission. 10 Sec. 4. (1) The commission shall do all of the following: 11 (a) Investigate and evaluate the current status of technol- 12 ogy in all aspects of state government. 13 (b) Review and make recommendations to executive departments 14 on all contracts for technology improvements in this state. 15 (c) Develop a statewide technology plan to improve 16 Michigan's technology capability for state government. 17 (d) Investigate technological problems in state government. 18 (2) Not later than November 1, 1999, and not later than 19 November 1 of each year thereafter, the commission shall develop 20 and submit to the governor and the legislature a report on its 21 activities and its recommendations concerning the matters 22 described in subsection (1). 06132'98 Final page.
