(1)A personAN INDIVIDUAL employed by the 2department of social services at the W.J. Maxey campus in3Whitmore lake or any of its affiliated facilities, at the Adrian4training school in Adrian, the Arbor Heights center in Ann Arbor,5Camp Nokomis in Prudenville, Camp Shawano in Grayling, or a simi-6lar facility under the jurisdiction of the department established7or funded by the state after the effective date of this section,8 FAMILY INDEPENDENCE AGENCY who is injured during the course of 9 his or her employment as a result of an assault by a recipient of 10socialBENEFITS OR services UNDER THIS ACT, BY AN INDIVIDUAL 11 ACTING IN CONCERT WITH OR AT THE DIRECTION OF SUCH A RECIPIENT, 06659'98 * CPD 2 1 BY AN INDIVIDUAL WHO IS AN APPLICANT FOR BENEFITS OR SERVICES 2 UNDER THIS ACT OR WHO IS THE SUBJECT OF AN INVESTIGATION BEING 3 CONDUCTED UNDER THIS ACT OR OTHER STATE OR FEDERAL LAW, OR BY AN 4 INDIVIDUAL ACTING IN CONCERT WITH OR AT THE DIRECTION OF SUCH AN 5 INDIVIDUAL shall receive his or her full wagesbyFROM the 6state departmentFAMILY INDEPENDENCE AGENCY until worker's com- 7 pensation benefits begin and then shall receive in addition to 8 worker's compensation benefits a supplement from thestate9department whichFAMILY INDEPENDENCE AGENCY THAT, together with 10 the worker's compensation benefits, shall equal but not exceed 11 the weekly net wage of the employee at the time of the injury. 12 This supplementshallonlyapplyAPPLIES while theperson13 INDIVIDUAL is on thestate department'sFAMILY INDEPENDENCE 14 AGENCY'S payroll and is receiving worker's compensation benefits. 15and shall include an employee who is currently receiving16worker's compensation due to an injury covered by this section.17 Fringe benefits normally received by an employeeshall be18 REMAIN in effect during the time the employee receives the sup- 19 plement provided by thissectionSUBSECTION from the 20departmentFAMILY INDEPENDENCE AGENCY. 21 (2) Subsection (1)shall applyAPPLIES whether the 22 employee was directly assaulted or was assaulted as a result of 23 aiding another employee in subduing a recipient. 06659'98 * Final page.
