A bill to amend 1895 PA 3, entitled "The general law village act," by amending section 4 of chapter VI (MCL 66.4), as amended by 1982 PA 346. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 CHAPTER VI 2 Sec. 4. (1) Within 15 days after the passage of an ordi- 3 nance, the CLERK SHALL PUBLISH THE ordinance or a synopsis of the 4 ordinanceshall be publishedin a newspaper circulated in the 5 village. IF THE CLERK PUBLISHES A SYNOPSIS OF THE ORDINANCE, THE 6 CLERK SHALL INCLUDE IN THE PUBLICATION THE LOCATION IN THE VIL- 7 LAGE WHERE A COPY OF THE ORDINANCE CAN BE INSPECTED OR OBTAINED. 8 Immediately afterpublicationTHE ORDINANCE OR SYNOPSIS IS 9 PUBLISHED, the clerk shall enter in the record of ordinances, in 10 a blank space to be left forthatTHIS purpose under the record 03735'97 TLG 2 1 of the ordinance, a SIGNED certificateunder the clerk's hand,2 stating thetime and places of the publicationDATE ON WHICH 3 AND THE NAME OF THE NEWSPAPER IN WHICH THE ORDINANCE WAS 4 PUBLISHED. The certificateshall beIS prima facie evidence of 5 thedueLEGAL publication of the ordinance or the synopsis. 6 (2) A village may adopt aplumbing code, electrical code,7or building code which has been promulgated by this state, by a8department, board, or other agency of this state, or by an organ-9ization or association which is organized or conducted for the10purpose of developing a codeSTATUTE OR RULE OF THIS STATE, 11 INCLUDING BUT NOT LIMITED TO A STATUTE OR RULE ADOPTING BY REFER- 12 ENCE A CODE PROMULGATED BY ANOTHER PUBLIC OR PRIVATE ENTITY OR A 13 STATUTE OR RULE CONSTITUTING THE TEXT OF A CODE, OR MAY ADOPT A 14 CODE PROMULGATED BY ANOTHER PUBLIC ENTITY OR A PRIVATE ENTITY, by 15 referenceto the codein an adopting ordinance and without pub- 16 lishing the STATUTE, RULE, OR code in full. IF AN ORDINANCE 17 ADOPTS BY REFERENCE A STATUTE OR RULE OF THIS STATE, THE ORDI- 18 NANCE MAY INCORPORATE FUTURE AMENDMENTS OR REVISIONS OF THE STAT- 19 UTE OR RULE BY EXPLICITLY PROVIDING THAT FUTURE AMENDMENTS OR 20 REVISIONS ARE INCORPORATED BY REFERENCE WHEN, OR A SPECIFIED 21 PERIOD OF TIME AFTER, THEY TAKE EFFECT IN THIS STATE. The 22 STATUTE, RULE, OR code shall be clearly identified in the ordi- 23 nance, and a statement of the purpose of the STATUTE, RULE, OR 24 code shall be published with the adopting ordinance OR WITH THE 25 SYNOPSIS OF THE ADOPTING ORDINANCE.Printed copiesCOPIES of 26 the STATUTE, RULE, OR code ADOPTED BY THE VILLAGE BY REFERENCE 27 shall be kept in the office of the village clerk, available for 03735'97 3 1 inspection by and distribution to the public.at all times.IF 2 A STATUTE OR RULE OF THIS STATE IS ADOPTED BY THE VILLAGE BY REF- 3 ERENCE AND THE STATUTE OR RULE ADOPTS BY REFERENCE A CODE PROMUL- 4 GATED BY ANOTHER PUBLIC ENTITY OR A PRIVATE ENTITY, COPIES OF THE 5 CODE ITSELF SHALL ALSO BE KEPT IN THE OFFICE OF THE VILLAGE 6 CLERK, AVAILABLE FOR INSPECTION BY AND DISTRIBUTION TO THE 7 PUBLIC.
