HOUSE BILL No. 5771 April 23, 1998, Introduced by Reps. Stallworth, Kilpatrick, Hale and Thomas and referred to the Committee on Appropriations. A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each clas- sification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan trans- portation fund and the use and administration of the fund for transportation purposes; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety pur- poses; to set up and establish the Michigan truck safety commis- sion; to establish certain standards for road contracts for cer- tain businesses; to provide for the continuing review of trans- portation needs within the state; to authorize the state trans- portation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropria- tions and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to pro- vide for the establishment and administration of the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive 05778'98 TJS 2 transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submis- sion of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and offi- cials; to provide for the making of loans for transportation pur- poses by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts," by amending section 9b (MCL 247.659b), as added by 1997 PA 79. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 9b. (1) Afterthe effective date of the amendatory2act that added this sectionJULY 28, 1997, the department shall 3 do all of the following regarding contracts to construct or 4 repair roads or bridges: 5 (a) Establish technical assistance programs to prepare 6 minority business enterprises to compete for contracts. 7 (b) Assist in creating and developing sources of nontradi- 8 tional capital to assist minority business enterprises to compete 9 for contracts. 10 (c) Assist in creating and developing incentives for firms 11 to mentor minority business enterprises to assist minority busi- 12 ness enterprises to gain the experience and resources necessary 13 to compete for contracts. 14 (d) Increase information programs to inform minority busi- 15 ness enterprises of opportunities to compete for contracts. 16 (2) The department shall notify the majority and minority 17 chairpersons of the house and senate appropriations committees 05778'98 3 1 and the majority and minority chairpersons of the house and 2 senate committees that consider transportation matters of each 3 contract awarded to minority business enterprises under this 4 section. 5 (3) As used in this section: 6 (a) "Minority business enterprise" means a business enter- 7 prise located within an empowerment zone or an enterprise zone 8 that is owned or controlled solely by 1 or more socially or eco- 9 nomically disadvantaged persons. The disadvantage may arise from 10 cultural, racial, gender, or chronic economic circumstances or 11 background, or other similar cause. 12 (b) "Empowerment zone" means an area designated as an empow- 13 erment zone by the United States department of housing and urban 14 development. 15 (c) "Enterprise zone" means a neighborhood enterprise zone 16 designated under the neighborhood enterprise zone act, 1992 PA 17 147, MCL 207.771 to 207.787. 18 (4) Afterthe effective date of the amendatory act that19added this sectionJULY 28, 1997, the department shall do all of 20 the following regarding contracts to construct or repair roads 21 and bridges: 22 (a) Consult with the Michigan state chamber of commerce and 23 the Michigan minority business development council on requests 24 for proposals and requests for quotations to ensure competitive 25 and inclusive strategies which ensure an inclusive and competi- 26 tive bid environment. 05778'98 4 1 (b) Appoint not less than 1 representative from the Michigan 2 minority business development council and theDBEDISADVANTAGED 3 BUSINESS ENTERPRISE division of theMichigandepartmentof4transportationto all requests for proposal and quote review 5 panels. 6 (c) Establish within theDBEDISADVANTAGED BUSINESS 7 ENTERPRISE division of theMichigandepartmentof8transportationa surety division to assist qualified bidders in 9 securing bonding and in monitoring vendor and supplier payments. 10 (5) THE DEPARTMENT SHALL HOLD AN ANNUAL EDUCATIONAL FORUM IN 11 EACH COUNTY IN THIS STATE IN WHICH 20% OR MORE OF THE POPULATION 12 IS COMPOSED OF MINORITIES OR MINORITY GROUPS IN ORDER TO PROVIDE 13 INFORMATION AND TECHNICAL ASSISTANCE TO AID THOSE PERSONS OR 14 GROUPS IN COMPETITION FOR TRANSPORTATION RELATED CONTRACTS. 05778'98 Final page.
