HOUSE BILL No. 5143


     September 30, 1997, Introduced by Reps. Brackenridge, Birkholz, Crissman, Hammerstrom and Dobronski and referred to the Committee on Local Government.


        A bill to amend 1966 PA 293, entitled

   "An act to provide for the establishment of charter counties; to
   provide for the election of charter commissioners; to prescribe
   their powers and duties; to prohibit certain acts of a county
   board of commissioners after the approval of the election of a
   charter commission; to prescribe the mandatory and permissive
   provisions of a charter; and to provide for the exercise by a
   charter county of certain powers whether or not authorized by its
   charter,"

   (MCL 45.501 to 45.521) by amending the title, as amended by 1994

   PA 20, and by adding section 2a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to provide for the establishment of charter counties;

 3    to provide for the election of charter commissioners; to pre-

 4    scribe their powers and duties; to prohibit certain acts of a

 5    county board of commissioners after the approval of the election

 6    of a charter commission; to prescribe the mandatory and

 1    permissive provisions of a charter;  and  to provide for the

 2    exercise by a charter county of certain powers whether or not

 3    authorized by its charter; AND TO PRESCRIBE PENALTIES AND PROVIDE

 4    REMEDIES.

 5         SEC. 2A.  A PETITION UNDER SECTION 2, 5(1), OR 19, INCLUDING

 6    THE CIRCULATION AND SIGNING OF THE PETITION, IS SUBJECT TO SEC-

 7    TION 488 OF THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.

 8    A PERSON WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW,

 9    1954 PA 116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION

10    DESCRIBED IN THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED

11    FOR THAT VIOLATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL

12    168.1 TO 168.992.

13         Enacting section 1.  This amendatory act does not take

14    effect unless Senate Bill No. _____ or House Bill No. _____

15    (request no. 02378'97) of the 89th Legislature is enacted into

16    law.
