A bill to amend 1972 PA 222, entitled "An act to provide for an official personal identification card; to provide for its form, issuance and use; to provide for certain duties of the secretary of state; and to prescribe certain penal- ties for violations," by amending section 2 (MCL 28.292), as amended by 1996 PA 204. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2. (1) The official state personal identification card 2 shall contain the following: 3 (a) An identification number permanently assigned to the 4 person. 5 (b) The full name, date of birth, sex, residential address, 6 height, weight, eye color, image, and signature of the person to 7 whom the identification card is issued. 8 (c) An indication that the identification card contains 1 or 9 more of the following: 02873'97 SAT 2 1 (i) The blood type of the person. 2 (ii) Immunization data of the person. 3 (iii) Medication data of the person. 4 (iv) A statement that the person is deaf. 5 (v) A statement that the person has made an anatomical 6 gift. 7 (vi) Emergency contact information of the person. 8 (2) The secretary of state shall prescribe the form of the 9 identification card. Except as otherwise required in this chap- 10 ter, other information required on the identification card pursu- 11 ant to this act may appear on the identification card in a form 12 prescribed by the secretary of state. 13 (3) The identification card shall not contain a fingerprint 14 or finger image of the applicant. 15 (4) The secretary of state may retain and use a person's 16 image described in subsection (1)(b) only for programs adminis- 17 tered by the secretary of state. Except as provided in this sub- 18 section, the secretary of state shall not use a person's image 19 unless written permission for that purpose is granted by the 20 person to the secretary of state or specific enabling legislation 21 permitting the use is enacted into law. A law enforcement agency 22 of this state shall have access to any information retained by 23 the secretary of state under this subsection. The information 24 may be utilized for any law enforcement purpose unless otherwise 25 prohibited by law. 26 (5) AT THE TIME OF INITIAL APPLICATION OR RENEWAL OF AN 27 OFFICIAL STATE PERSONAL IDENTIFICATION CARD, THE SECRETARY OF 02873'97 3 1 STATE SHALL INFORM A PERSON OF THE RIGHT TO HAVE HIS OR HER NAME 2 AND OTHER INFORMATION FROM THE COMPUTERIZED CENTRAL FILE OF 3 INFORMATION MAINTAINED UNDER THIS ACT CODED CONFIDENTIAL. 4 INFORMATION PERTAINING TO A PERSON WHOSE NAME IS CODED CONFIDEN- 5 TIAL SHALL ONLY BE MADE AVAILABLE TO THE PERSON WHO HAS HAD HIS 6 OR HER NAME CODED CONFIDENTIAL, LAW ENFORCEMENT AGENCIES, AND THE 7 SECRETARY OF STATE AND SHALL REMAIN CONFIDENTIAL UNTIL THE PERSON 8 NOTIFIES THE SECRETARY OF STATE IN WRITING TO REMOVE THE INFORMA- 9 TION FROM THE CONFIDENTIAL PORTION OF THE FILE. 10 (6)(5)If a person presents evidence of statutory blind- 11 ness as provided inAct No. 260 of the Public Acts of 1978,12being sections 393.351 to 393.368 of the Michigan Compiled Laws13 1978 PA 260, MCL 393.351 TO 393.368, and is issued or is the 14 holder of an official state personal identification card, the 15 secretary of state shall mark the person's identification card in 16 a manner that clearly indicates that the cardholder is legally 17 blind. 18 (7)(6)If the secretary of state issues an official state 19 personal identification card to a person who at the time of 20 application is 20-1/2 years of age or less, the secretary of 21 state shall mark the person's identification card in a manner 22 that clearly indicates that the cardholder is less than 21 years 23 of age. 24 (8)(7)An official state personal identification card may 25 contain an identifier for voter registration purposes. An offi- 26 cial state personal identification card may contain information 27 appearing in electronic or machine readable codes needed to 02873'97 4 1 conduct a transaction with the secretary of state. The 2 information shall be limited to the person's identification card 3 number, birth date, expiration date, and other information neces- 4 sary for use with electronic devices, machine readers, or auto- 5 matic teller machines and shall not contain the person's name, 6 address, driving record, or other personal identifier. The iden- 7 tification card shall identify the encoded information. 8 (9)(8)An official state personal identification card 9 shall be issued only upon authorization of the secretary of 10 state, and shall be manufactured in a manner to prohibit as 11 nearly as possible the ability to reproduce, alter, counterfeit, 12 forge, or duplicate the identification card without ready 13 detection. 14 (10)(9)The secretary of state shall not issue an offi- 15 cial state personal identification card to a person who holds an 16 operator's or chauffeur's license issued pursuant to the Michigan 17 vehicle code,Act No. 300 of the Public Acts of 1949, being sec-18tions 257.1 to 257.923 of the Michigan Compiled Laws1949 PA 19 300, MCL 257.1 TO 257.923, unless the license has been suspended, 20 revoked, or restricted. 21 (11)(10)Except as otherwise provided in this act, an 22 applicant shall pay a fee of $6.00 to the secretary of state for 23 each original or renewal identification card issued. Until 24 January 1, 2002, a service fee of $1.00 shall be added to each 25 fee collected for an original or renewal identification card. 26 The department of treasury shall deposit the fees received and 27 collected under this section in the state treasury to the credit 02873'97 5 1 of the general fund. The legislature shall appropriate the fees 2 credited to the general fund under this act to the secretary of 3 state for the administration of this act. Appropriations from 4 the Michigan transportation fund shall not be used to compensate 5 the secretary of state for costs incurred and services performed 6 under this section. 7 (12)(11)An original or renewal official state personal 8 identification card shall expire on the birthday of the person to 9 whom it is issued in the fourth year following the date of 10 issuance. The secretary of state shall not issue an official 11 state personal identification card under this act for a period 12 greater than 4 years. A person may apply for a renewal of an 13 official state personal identification card by mail or by other 14 methods prescribed by the secretary of state. 15 (13)(12)The secretary of state shall waive the fee under 16 this section if the applicant is a person 65 years of age or 17 older, is a person who has had his or her operator's or 18 chauffeur's license suspended, revoked, or denied underAct19No. 300 of the Public Acts of 1949THE MICHIGAN VEHICLE CODE, 20 1949 PA 300, MCL 257.1 TO 257.923, because of a mental or physi- 21 cal infirmity or disability, or is a person who presents evidence 22 of statutory blindness as provided inAct No. 260 of the Public23Acts of 19781978 PA 260, MCL 393.351 TO 393.368. 24 (14)(13)A person who has been issued an official state 25 personal identification card shall apply for a renewal official 26 state personal identification card if the person changes his or 27 her name. 02873'97 6 1 (15)(14)A person who has been issued an official state 2 personal identification card shall apply for a corrected identi- 3 fication card if he or she changes his or her residential 4 address. The secretary of state may correct the address on an 5 identification card by a method prescribed by the secretary of 6 state. A fee shall not be charged for a change of residential 7 address. 8 (16)(15)Except as otherwise provided in subsections 9(13)(14) and(14)(15), a person who has been issued an 10 official state personal identification card may apply for a 11 renewal official state personal identification card for 1 or more 12 of the following reasons: 13 (a) The person wants to change any information on the iden- 14 tification card. 15 (b) An identification card issued under this act is lost, 16 destroyed, mutilated, or becomes illegible. 17 (17)(16)The secretary of state shall establish and main- 18 tain a computerized central file of the information contained on 19 application forms received under this act. The computerized cen- 20 tral file shall be interfaced with the law enforcement informa- 21 tion network as provided in the L.E.I.N. policy council act of 22 1974,Act No. 163 of the Public Acts of 1974, being sections2328.211 to 28.216 of the Michigan Compiled Laws1974 PA 163, MCL 24 28.211 TO 28.216. 25 (18)(17)A person may indicate on an official state per- 26 sonal identification card in a place designated by the secretary 27 of state his or her blood type, emergency contact information, 02873'97 7 1 immunization data, medication data, a statement that the person 2 is deaf, or a statement that the person has made an anatomical 3 giftpursuant toUNDER part 101 of the public health code,Act4No. 368 of the Public Acts of 1978, being sections 333.10101 to5333.10109 of the Michigan Compiled Laws1978 PA 368, MCL 6 333.10101 TO 333.10109. 7 (19)(18)If an applicant provides proof to the secretary 8 of state that he or she is a minor who has been emancipated 9pursuant to Act No. 293 of the Public Acts of 1968, being sec-10tions 722.1 to 722.6 of the Michigan Compiled LawsUNDER 1968 PA 11 293, MCL 722.1 TO 722.6, the official state personal identifica- 12 tion card shall bear the designation of the individual's emanci- 13 pated status in a manner prescribed by the secretary of state. 14 Enacting section 1.
