     April 15, 1997, Introduced by Reps. McManus, Goschka, Jelinek, Law, Horton and Gernaat and referred to the Committee on Consumer Protection.


        A bill to authorize an award of damages for harm caused by a

   false or misleading statement of fact relating to a food

   product.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1.  (1) A person who conveys to a third party a false

 2    or misleading statement of fact relating to the food product of

 3    another person is liable for all damages proximately caused by

 4    the false or misleading statement of fact.

 5         (2) As used in this section:

 6         (a) "False or misleading statement of fact" means a factual

 7    assertion that is not supported by scientific or other evidence.

 8         (b) "Food product" means a food or beverage offered or sold

 9    for human consumption.

 1         (c) "Third party" means a person other than the producer,

 2    distributor, or seller of the food product that is the subject of

 3    a false or misleading statement.
