SELLER’S DISCLOSURE FORM H.B. 5418 (H-1): FLOOR ANALYSIS

The bill would amend the Seller Disclosure Act to revise the provision in a seller’s disclosure statement concerning proximity to a farm operation. The bill also provides that a seller’s disclosure form, as described in the Act, that was printed before the bill’s effective date, that complied with Public Act 106 of 1995, and that differed from the bill regarding notice of a farm or farm operation in the vicinity could be used and would comply with the Act until July 1, 1996.
Currently, the disclosure statement asks whether the seller is aware of a “Farm or farm operation in the vicinity or proximity to a landfill, airport, shooting ranges, etc.?” The bill would insert a semicolon into the phrase, and refer to a shooting range, so that the question would read as follows: “Farm or farm operation in the vicinity; or proximity to a landfill, airport, shooting range, etc.?”
Public Act 106 of 1995 amended the Act to require a seller’s disclosure statement to indicate whether a farm or farm operation is in the vicinity of the property.
The bill includes an effective date of January 1, 1996.
