FLEEING & ELUDING: FORFEITURE H.B. 4535 (S-1): FLOOR ANALYSIS

The bill would amend the Revised Judicature Act (RJA) to include first-, second-, and third-degree fleeing and eluding, as proposed by Senate Bill 378 and House Bill 4534, in the list of crimes subject to forfeiture proceedings. The RJA provides for the seizure and forfeiture of property that is the proceeds, substituted proceeds, or instrumentality of specified crimes.
The bill would take effect on June 1, 1997, and is tie-barred to Senate Bill 378 and House Bill 4534, which would create the felonies of first-, second-, third-, and fourth-degree fleeing and eluding.

Local law enforcement agencies could be able to obtain property from forfeiture provisions under amendments in House Bill 4535 (S-1) that would add the crimes of first-, second-, and third-degree fleeing and eluding to the list of crimes for which prosecutors may seek forfeiture of property.
