REGULATE GRAIN HAULERS H.B. 4333 (S-3): FLOOR ANALYSIS

The bill would amend the Grain Dealers Act to provide for the registration and regulation of grain haulers, including establishing an annual registration fee of $50; requiring a grain hauler to record on a form the type and amount of farm produce subject to cash sale and to state that the sale was not regulated by the Act; and, requiring the grain hauler to make the form available to the Department of Agriculture. The bill would establish misdemeanor penalties for a person who acted as a grain dealer or hauler without being licensed or registered; and for grain haulers who did not present the required cash sale form or who failed to pay for the farm produce at the time of delivery. In addition, the bill specifies that a price later agreement provided to a grower or owner by certified mail would be considered delivered, and provides that an unsigned price later agreement, after the delivery of farm produce and absent any other written agreement, would be considered acceptance of that agreement.
The bill also would amend the definition of “cash sale”, which is farm produce whose title is transferred only after a price is decided upon by the time of delivery, to add “in which payment is made to the grower or producer by check or cash”.

The bill would have a minimal impact on the State as it is anticipated that only four or five people would apply for registration as a hauler.
There would be no fiscal impact on local government.
