A bill to amend 1988 PA 466, entitled

"Animal industry act,"

by amending section 30a (MCL 287.730a), as amended by 2002 PA 458.

the people of the state of michigan enact:

Sec. 30a. (1) Privately owned cervids, except those consigned directly to a state or federally inspected slaughter facility premises, shall not be imported Subject to subsection (2), the following apply to a privately owned cervid imported into this state:

(a) A person shall not import a live cervid into this state unless it is accompanied by an official interstate health certificate or official interstate certificate of veterinary inspection.

(b) If a live cervid is consigned directly to a state or federally inspected slaughter facility premises, a person may import the cervid into this state without either of the certificates described in subdivision (a).

(2) Beginning on the effective date of the 2019 amendatory act that added this subsection, a person shall not do either of the following:

(a) Import into this state a live cervid from a region, as defined by the department, in which a cervid has tested positive for chronic wasting disease in the preceding 10 years. The department shall post on its website a list of regions in which a cervid has tested positive for chronic wasting disease. The posting must include a statement indicating that importation of a live cervid from a listed region is prohibited.

(b) Transport a live cervid into or out of a local unit of government in this state that the department has identified as an area in which a cervid has tested positive for chronic wasting disease. The department shall post on its website a list of local units of government in which a cervid has tested positive for chronic wasting disease. The posting must include a statement indicating that transportation of a live cervid into or out of a listed local unit of government is prohibited. As used in this subdivision, "local unit of government" means a township, village, or city.

(3) (2) Privately A privately owned cervids cervid imported into this state shall be individually identified by an official identification. The official identification shall must be listed on the official interstate health certificate or official interstate certificate of veterinary inspection.

(4) (3) Privately A privately owned cervids cervid 6 months of age or older imported into this state, except those a cervid that is consigned directly to a state or federally inspected slaughter facility premises, shall must originate directly from a certified brucellosis-free cervid herd, as defined in brucellosis in cervidae: uniform methods and rules, effective Brucellosis in Cervidae: Uniform Methods and Rules, Effective September 30, 1998, or shall test negative to an official test for brucellosis within not more than 30 days before importation.

(5) (4) Privately A privately owned cervids cervid 1 year of age or older imported into this state, except those a cervid that is consigned directly to a state or federally inspected slaughter facility premises, must comply with 1 of the following before importation:

(a) Originate The cervid must originate directly from an official tuberculosis accredited herd as outlined in bovine tuberculosis eradication: uniform methods and rules, effective Bovine Tuberculosis Eradication: Uniform Methods and Rules, Effective January 22, 1999, approved by veterinary services Veterinary Services of the animal and plant health inspection service Animal and Plant Health Inspection Service of the United States department of agriculture, Department of Agriculture, and all amendments to those publications thereafter that publication adopted pursuant to under rules that the director may promulgate.

(b) Originate The cervid must originate directly from an official tuberculosis qualified or monitored herd as outlined in bovine tuberculosis eradication: uniform methods and rules, effective Bovine Tuberculosis Eradication: Uniform Methods and Rules, Effective January 22, 1999, approved by veterinary services Veterinary Services of the animal and plant health inspection service Animal and Plant Health Inspection Service of the United States department of agriculture, Department of Agriculture, and all amendments to those publications thereafter that publication adopted pursuant to under rules that the director may promulgate, and receive an official test negative test to an official test for tuberculosis within not more than 90 days before importation.

(c) Be The cervid must be isolated from all other animals until it receives 2 official tests negative to each of 2 official tests for tuberculosis tests conducted no less than 90 days apart, with the first test conducted no not more than 120 days before importation.

(6) (5) All A privately owned cervids cervid less than 1 year of age imported into this state, except those a cervid that is consigned directly to a state or federally inspected slaughter facility premises, must comply with 1 of the following before importation:

(a) Originate The cervid must originate directly from an official tuberculosis accredited herd as outlined in bovine tuberculosis eradication: uniform methods and rules, effective Bovine Tuberculosis Eradication: Uniform Methods and Rules, Effective January 22, 1999, approved by veterinary services Veterinary Services of the animal and plant health inspection service Animal and Plant Health Inspection Service of the United States department of agriculture, Department of Agriculture, and all amendments to those publications thereafter that publication adopted pursuant to under rules that the director may promulgate.

(b) Be The cervid must be born in and originate directly from an official tuberculosis qualified or monitored herd as outlined in bovine tuberculosis eradication: uniform methods and rules, effective Bovine Tuberculosis Eradication: Uniform Methods and Rules, Effective January 22, 1999, approved by veterinary services Veterinary Services of the animal and plant health inspection service Animal and Plant Health Inspection Service of the United States department of agriculture, Department of Agriculture, and all amendments to those publications thereafter that publication adopted pursuant to under rules that the director may promulgate.

(c) Be The cervid must be a purchased addition originating directly from an official tuberculosis qualified or monitored herd as outlined in bovine tuberculosis eradication: uniform methods and rules, effective Bovine Tuberculosis Eradication: Uniform Methods and Rules, Effective January 22, 1999, approved by veterinary services Veterinary Services of the animal and plant health inspection service Animal and Plant Health Inspection Service of the United States department of agriculture, Department of Agriculture, and all amendments to those publications thereafter that publication adopted pursuant to under rules that the director may promulgate, and receive an official test negative test to an official test for tuberculosis within not more than 90 days before importation.

(d) Be The cervid must be isolated from all other animals until it receives 2 official tests negative to each of 2 official tests for tuberculosis tests conducted not less than 90 days apart, with the first test conducted no not more than 120 days before importation.

(7) (6) Privately A privately owned cervids cervid with a response other than negative to any a tuberculosis test or brucellosis test are is not eligible for interstate movement into this state without permission from unless permitted by the director.

(8) (7) Privately A privately owned cervids cervid known to be affected with or exposed to tuberculosis or brucellosis are is not eligible for interstate movement into this state without permission from unless permitted by the director.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
