A bill to amend 1976 PA 451, entitled

"The revised school code,"

by amending section 1201 (MCL 380.1201), as amended by 2001 PA 27.

the people of the state of michigan enact:

Sec. 1201. (1) The business that the board of a school district or board of directors of a public school academy is authorized to perform shall must be conducted at a public meeting of the board or board of directors held in compliance with the open meetings act, 1976 PA 267, MCL 15.261 to 15.275. An act of the board or board of directors is not valid unless the act is authorized at a meeting by a majority vote of the members elected or appointed to and serving on the board or board of directors and a proper record is made of the vote.

(2) The board or board of directors may hold closed sessions only as authorized by section 8 of the open meetings act, 1976 PA 267, MCL 15.268.

(3) A meeting at which all members are present, with or without proper notice to members of the board or board of directors, and for which proper notice is given to the public pursuant to under subsection (4), is considered a legal meeting for the transaction of business.

(4) The board or board of directors shall give public notice of the time, date, and place of the meeting in the manner required by the open meetings act, 1976 PA 267, MCL 15.261 to 15.275.

(5) The minutes of each board or board of directors meeting shall must be signed by the secretary. In the absence of the secretary, the president shall appoint a temporary secretary who shall sign the minutes of the meeting. The vice-president shall act in the absence of the president.

(6) The board or board of directors shall hold a regular public meeting at least once a month. The board of directors of a public school academy shall hold its public meeting under this subsection at the public school academy. The board of directors of a school of excellence that is a cyber school, as described in section 553a, shall hold a public meeting at least once each month within the school district in which the greatest number of pupils enrolled in the cyber school reside and shall broadcast each meeting on the cyber school's website free of charge.
