A bill to amend 1937 PA 306, entitled

"An act to promote the safety, welfare, and educational interests of the people of the state of Michigan by regulating the construction, reconstruction, and remodeling of certain public or private school buildings or additions to such buildings, by regulating the construction, reconstruction, and remodeling of buildings leased or acquired for school purposes, and to define the class of buildings affected by this act; to prescribe the powers and duties of certain state agencies and officials; to prescribe penalties for the violation of this act; and to repeal acts and parts of acts,"

by amending the title and section 1a (MCL 388.851a), the title as amended by 2002 PA 628, and by adding section 1c.

the people of the state of michigan enact:

TITLE

An act to promote the safety, welfare, and educational interests of the people of the state of Michigan by regulating the construction, reconstruction, and remodeling, and monitoring systems of certain public or private school buildings or additions to such those buildings , and by regulating the construction, reconstruction, and remodeling, and monitoring systems of buildings leased or acquired for school purposes; , and to define the class of buildings affected by this act; to prescribe the powers and duties of certain state agencies and officials; to prescribe penalties for the violation of this act; and to repeal acts and parts of acts.

Sec. 1a. (1) Words and phrases As used in this act: shall be defined as follows:

(a) "School buildings" shall include all buildings used for school purposes.

(a) "Addition" means added space that results in additional cubic contents to an existing building.

(b) "Carbon monoxide device" means a device that detects carbon monoxide, alerts occupants via a distinct and audible signal that is either self-contained in the unit or activated via a system connection, and is certified by a nationally recognized testing laboratory to conform to the latest standards of the Underwriters Laboratories standards.

(c) "Operational" means working and in service.

(d) (b) "Remodeling" shall mean means the alteration, construction, or remodeling of partitions, hallways, stairways, and means of egress , or the replacement, relocation, or reconstruction of heating, ventilating, and sanitary equipment.

(c) "Addition" shall mean added space which results in additional cubic contents to existing building.

(e) "School building" includes all buildings used for school purposes.

(f) "Source point" means an area where a mechanism is present that provides a common source of heat from a fossil-fuel-burning furnace, boiler, or water heater. Source point does not include an area where only a wood or fossil-fuel-burning fireplace or a wood or fossil-fuel-burning space heater is present.

(g) (d) "Total cost" shall be interpreted to mean means the monetary worth of the building when ready for occupancy, regardless of the source of funds, labor, or material and shall include includes the cost of general construction, plumbing, heating and ventilation, electrical work, and all fixed equipment, together with the cost of architects, engineers, and building superintending services.

(2) (e) A building having a basement shall be is considered to be a 2 story 2-story building for the purposes of this act.

Sec. 1c. (1) Beginning October 1, 2019, a school district shall have installed not less than 1 operational carbon monoxide device at each source point in each school building within the school district. Notwithstanding section 5a(1), this section applies to all school buildings and additions to school buildings, and to the construction, reconstruction, or remodeling of a school building.

(2) The carbon monoxide device described in subsection (1) may be battery-powered, plug-in with or without battery backup, wired into the building's AC power line with secondary battery backup, or connected to a system by means of a control panel. The carbon monoxide device required under subsection (1) must have an alarm that is audible.

(3) A person who installs, in accordance with the manufacturer's published instructions in existence at the time of installation, a carbon monoxide device under this section shall have no liability, directly or indirectly, to any person with respect to the operation, maintenance, or effectiveness of the carbon monoxide device.
